It is the policy of Boston Scientific to comply with all applicable laws governing the processing of personal information, including those associated with the safeguarding of sensitive or protected health information. Implementation of this policy is subject to specific federal and state laws. Furthermore, Boston Scientific abides by the Generally Accepted Privacy Principles (GAPP) such as:
Management:
Boston Scientific has a program designed to protect personal information in its possession or control. This is done through a variety of privacy and security policies, processes and procedures. This program is overseen by Boston Scientific’s Global Privacy Office.
Notice:
Boston Scientific, through this policy, provides notice about its privacy practices relating to personal information obtained through myLUX™ Patient App. This policy may change from time to time. If Boston Scientific makes a material change to this policy, it will highlight such changes for at least 30 days. Your continued use of myLUX™ Patient App after revision to this policy means you accept those changes, so please check the policy periodically for updates.
Choice and consent:
Boston Scientific provides patients the ability to choose and consent, where applicable, how personal information is handled in the myLUX™ Patient App.

Children Under the Age of 18
The myLUX™ Patient App is not intended for children under 18 years of age, and we do not knowingly collect personal information from children under 18 without the explicit consent of a parent or legal guardian. In the event that we become aware that we have collected personal information from any minor without such consent, we will dispose of that information in accordance with applicable laws and regulations. If your child has submitted personal information and you would like to request that such information be deleted from our records, you may do so by contacting us via the contact options below.
Please note that for a patient to be enrolled in the LATITUDE platform, it is required that the doctor or healthcare institution ensures that the patient or the patient’s parent or legal guardian has provided appropriate consent under applicable law.
Who is responsible for your Personal Data?
A specific company from the Boston Scientific Group (collectively “BSC”), the manufacturer of your device, is responsible for receiving and processing your personal data in order to operate, manage, and maintain the LUX Dx™ ICM System (together "ICM") and for other purposes as detailed below. What is the myLUX™ Patient App and who has access to the data?
You have been implanted with a Boston Scientific cardiac monitor. The myLUX™ Patient App is needed in order to allow your physician to monitor your health condition remotely. This includes the monitoring of health data from your implanted device, symptoms collected from you (if enabled by your physician) and information provided by your physician.
- Your mobile device will send your personal data through the myLUX™ Patient App to a secure computer server (LATITUDE Clarity) located in the United States for patients followed in the United States and in the European Union for other patients via cellular or WIFI network.
- To provide adequate and timely support, global technical service centers in the United States, Belgium, Australia, Japan and India, may receive and handle requests addressed to them by your healthcare provider. A list of the Boston Scientific group entities is available upon request at the address of your local Boston Scientific Office or via email at: GlobalPrivacy@bsci.com.
What personal data does Boston Scientific collect and process through this application?
- Data collected from you:
- Your date of birth;
- Your telephone number;
- Your email address (only if the application is on your personal mobile device); and
- Your Symptoms entered by you.
- Data collected from your implanted device:
- Implanted device model and serial number;
- Data relating to your device itself (settings and status indicators); and
- Health data (measurements and diagnostics, cardiac events and symptom events).
- Data collected from the LATITUDE Clarity™ website:
- Your name and/or clinic-defined identifier;
- The treating clinic name and contact information; and
- The clinical reason for monitoring.
Please note that your name will only be visible if your doctor or relevant clinical representative has filled in that information.
Bluetooth is required for the application to communicate with your implanted device. The application may request permission to communicate via Bluetooth. Based on the mobile device used, location may need to be enabled and allowed in order to use Bluetooth, but your location is not tracked or used for any other purpose by the application.
Boston Scientific shall keep this information secure in accordance with applicable data protection laws in your country of residence, including the General Data Protection Regulation in the EU.
Please note the following:
- Your myLUX™ Patient App data is available to your physician and Boston Scientific can automatically send data to your clinic based on their settings for monitoring your device. Such data is only seen by the clinic when they access your information through or from the LATITUDE Clarity™ website.
- If there is an emergency you should phone for urgent medical assistance.
For what purposes is your Personal Data being processed?
Boston Scientific collects and has access to measurements from the device to:
- Enable application setup and system enrollment;
- Allow retrieval and storage of your implanted device and health data through the myLUX™ application and LUX-Dx™ Clinic Assistant application;
- Enable access to your personal data by your physician or authorized healthcare professionals through the LATITUDE Clarity™ website;
- Provide your healthcare provider with notification of specific events, diagnostic data and reports;
- Allow technical support by Boston Scientific personnel;
- Meet regulatory reporting requirements regarding medical device quality and safety to public authorities or regulatory bodies in your country of residence or in the U.S;
- Establish, exercise or defend legal claims; and
- Comply with other applicable legal and compliance requirements.
Data collected from the app will be sent to the LATITUDE Clarity website and any analysis of such data will be subject to the consent obtained at the time of the device implant and enrollment.
How long does Boston Scientific keep your personal data?
Your data will be kept by Boston Scientific as part of your implanted device record in LATITUDE Clarity for 6 years after your device is inactive, unless a longer retention period is necessary to comply with a legal obligation.
If you have been provided a mobile device with the application and wish to discontinue remote monitoring, contact your physician. Data stored on the mobile device by the application will be deleted when remote monitoring is discontinued.
If the application is on your personal mobile device, please note that if you delete the application this will trigger the deletion of the data that the application has stored onto your mobile device. However, all the remote monitoring information that has been sent to LATITUDE Clarity will remain as described as described at the beginning of this section.
What are your rights?
You have specific rights with respect to the processing of your personal data and health data by Boston Scientific, which are detailed here. You have the right to withdraw your consent to this processing at any time. The withdrawal of your consent does not affect the lawfulness of processing based on consent before its withdrawal.
Under certain circumstances as set forth in applicable law you may have the following rights:
- Right of access: The right to obtain confirmation as to whether or not your personal data is processed, and, if so, to request access to such personal data as well as other information about such processing that are also contained in this form.
- Right to rectification: The right to have inaccurate personal data about you rectified or completed if it is incomplete.
- Right to erasure ('right to be forgotten'): The right to request that Boston Scientific erases your personal data.
- Right to restriction of processing: The right to request from Boston Scientific that it limits the way it uses your personal data.
- Right to object: The right to object, on grounds relating to your particular situation at any time to the processing of your personal data and Boston Scientific may have to stop processing your data unless it demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms, or for the establishment, exercise or defense of legal claims.
- Right to data portability: The right to receive the personal data you provided, in a structured, commonly used and machine-readable form and to transmit that data to another controller or to have it transmitted directly from Boston Scientific to another controller.
California Privacy Rights: The Boston Scientific Privacy Notice for California Residents provides additional information for California residents under the California Consumer Privacy Act of 2018 (CCPA).

Menores de 18 años
La aplicación del paciente myLUX™ no está concebida para menores de 18 años y no recopilamos deliberadamente información personal de menores de 18 años sin el consentimiento expreso de un progenitor o tutor legal. ¿Qué datos personales recopila y somete a tratamiento Boston Scientific a través de esta aplicación?
- Datos de usted:

- Número de teléfono
- Dirección de correo electrónico (solo si la aplicación se encuentra instalada en su dispositivo móvil personal)
- Síntomas introducidos por usted
- Datos del dispositivo implantado:

¿Con qué propósito se someten a tratamiento sus datos personales?
Boston Scientific recopila las mediciones del dispositivo y accede a ellas para:

¿Durante cuánto tiempo conserva Boston Scientific los datos personales?
Boston Scientific conservará en LATITUDE Clarity los datos como parte del registro del dispositivo implantado durante un plazo de 6 años a contar desde el momento en que el dispositivo quede inactivo, a menos que una obligación legal imponga un período de retención más extenso.
Si se le ha proporcionado un dispositivo móvil con la aplicación y desea interrumpir la monitorización remota, póngase en contacto con su médico. Los datos que la aplicación almacena en el dispositivo móvil se eliminarán cuando se interrumpa la monitorización remota.

¿Cuáles son sus derechos?

Wie lange speichert Boston Scientific Ihre personenbezogenen Daten?
Ihre Daten werden von Boston Scientific als Teil des Datensatzes Ihres implantierten Geräts in LATITUDE Clarity für 6 Jahre nach der Inaktivierung Ihres Geräts aufbewahrt, es sei denn, eine längere Aufbewahrungsfrist ist erforderlich, um einer gesetzlichen Verpflichtung nachzukommen.
Wenn Sie ein Mobilgerät mit der Anwendung erhalten haben und die Fernüberwachung beenden möchten, wenden Sie sich an Ihren Arzt. Die von der Anwendung auf dem Mobilgerät gespeicherten Daten werden gelöscht, wenn die Fernüberwachung eingestellt wird.
Wenn sich die Anwendung auf Ihrem persönlichen Mobilgerät befindet, beachten Sie bitte, dass das Löschen der Anwendung auch das Löschen der Daten auslöst, die die Anwendung auf Ihrem Mobilgerät gespeichert hat. Combien de temps Boston Scientific conserve-t-il vos données personnelles ?
Vos données seront conservées par Boston Scientific dans le cadre de l'enregistrement de votre dispositif implanté dans LATITUDE Clarity pendant 6 ans après la désactivation de votre dispositif, à moins qu'une période de conservation plus longue ne soit nécessaire pour se conformer à une obligation légale.

- Per fornire un supporto adeguato e tempestivo, i centri di assistenza tecnica globale negli Stati Uniti, in Belgio, Australia, Giappone e India possono ricevere e gestire le richieste loro indirizzate dal Suo operatore sanitario. Quali dati personali vengono raccolti e trattati da Boston Scientific tramite questa applicazione?

- numero di telefono;
- indirizzo e-mail (solo se l'applicazione è installata sul Suo dispositivo mobile personale); e
- sintomi inseriti da Lei.
- Dati raccolti dal dispositivo impiantato:
- modello e numero di serie del dispositivo impiantato;
- dati relativi al Suo dispositivo (impostazioni e indicatori di stato); e
- dati sanitari (misurazioni e diagnostica, eventi cardiaci ed eventi sintomi).
- Dati raccolti dal sito web LATITUDE Clarity™:
- nome e/o identificativo definito dalla clinica;
- nome clinica curante e recapiti; e
- motivo clinico del monitoraggio.
Tenga presente che il Suo nome sarà visibile solo se il Suo medico o rappresentante clinico pertinente ha compilato tali informazioni.
Affinché l'applicazione comunichi con il dispositivo impiantato è necessario il Bluetooth. L'applicazione potrebbe richiedere l'autorizzazione per comunicare tramite Bluetooth. In base al dispositivo mobile utilizzato, potrebbe essere necessario essere abilitati e autorizzati per utilizzare il Bluetooth, ma la Sua posizione non viene tracciata o utilizzata per scopi diversi dall'applicazione.
Boston Scientific manterrà queste informazioni al sicuro in conformità con le leggi sulla protezione dei dati applicabili nella Sua nazione di residenza, incluso il Regolamento generale sulla protezione dei dati nell'UE.

Per quali finalità vengono trattati i Suoi dati personali?
Boston Scientific raccoglie e ha accesso alle misurazioni dal dispositivo per:
- abilitare la configurazione dell'applicazione e la registrazione del sistema;
- consentire il recupero e la memorizzazione del dispositivo impiantato e dei dati sanitari tramite l'applicazione myLUX™ e l'applicazione LUX-Dx™ Clinic Assistant;
- consentire l'accesso ai Suoi dati personali da parte del Suo medico o di operatori sanitari autorizzati attraverso il sito web LATITUDE Clarity™;
- fornire al Suo medico la notifica di eventi specifici, dati diagnostici e report;
- consentire il supporto tecnico da parte del personale Boston Scientific;
- soddisfare i requisiti di segnalazione normativa in materia di qualità e sicurezza dei dispositivi medici alle autorità pubbliche o agli organismi regolatori nella Sua nazione di residenza o negli Stati Uniti;
- stabilire, esercitare o difendere diritti legali; e
- rispettare gli altri requisiti legali e di conformità applicabili.
I dati raccolti dall'app saranno inviati al sito web LATITUDE Clarity e qualsiasi analisi di tali dati sarà subordinata al consenso ottenuto al momento dell'impianto del dispositivo e dell'arruolamento.
Per quanto tempo Boston Scientific conserva i Suoi dati personali?
I Suoi dati saranno conservati da Boston Scientific all'interno del registro del Suo dispositivo impiantato in LATITUDE Clarity per 6 anni dopo che il Suo dispositivo è inattivo, a meno che non sia necessario un periodo di conservazione più lungo per adempiere a un obbligo legale.
Se Le è stato fornito un dispositivo mobile con l'applicazione e desidera interrompere il monitoraggio remoto, contatti il Suo medico. I dati memorizzati sul dispositivo mobile dall'applicazione verranno eliminati quando il monitoraggio remoto verrà interrotto.
Se l'applicazione è installata sul Suo dispositivo mobile personale, tenga presente che, se la cancella, attiverà la cancellazione dei dati che l'applicazione ha memorizzato sul dispositivo. Welke persoonsgegevens verzamelt en verwerkt Boston Scientific via deze applicatie?
- Van u verzamelde gegevens:
- Uw geboortedatum;
- Uw telefoonnummer;
- Uw e-mailadres (alleen als de applicatie zich op uw persoonlijke mobiele apparaat bevindt); en
- Door u ingevoerde symptomen.
- Van uw geïmplanteerde apparaat verzamelde gegevens:
- Model en serienummer van het geïmplanteerde apparaat;
- Gegevens gerelateerd aan het apparaat zelf (instellingen en statusindicators); en
- Gezondheidsgegevens (metingen en diagnostiek, hartepisode en gebeurtenissen van symptomen).
- Van de LATITUDE Clarity™ website verzamelde gegevens:
- Uw naam en/of door de kliniek gedefinieerde identificator;
- De naam en contactgegevens van de behandelende kliniek; en
- De klinische reden voor monitoring.
Merk op dat uw naam alleen zichtbaar is als uw arts of relevante klinische vertegenwoordiger die informatie heeft ingevuld.
De applicatie vereist Bluetooth om te communiceren met uw geïmplanteerde apparaat. De applicatie kan verzoeken om toestemming om te communiceren via Bluetooth. Het kan, afhankelijk van het gebruikte mobiele apparaat, nodig zijn om locatie in te schakelen en toe te staan om Bluetooth te gebruiken, maar uw locatie wordt door de applicatie niet voor enig ander doel gevolgd of gebruikt.
Boston Scientific dient deze informatie veilig te houden in overeenstemming met toepasselijke wetgeving inzake gegevensbescherming in het land waar u verblijft, inclusief de algemene verordening gegevensbescherming in de EU.
Let op het volgende:
- De gegevens van uw myLUX™ Patient-app zijn beschikbaar voor uw arts en Boston Scientific kan automatische gegevens naar uw kliniek verzenden, op basis van hun instellingen voor het monitoren van uw apparaat. Dergelijke gegevens is alleen zichtbaar voor de kliniek als zij uw informatie openen via of vanuit de LATITUDE Clarity™ website.

Voor welke doeleinden worden uw persoonsgegevens verwerkt?
Boston Scientific verzamelt en heef toegang tot metingen van het apparaat om:
- Installatie van de applicatie en registratie bij het systeem mogelijk te maken;
- Het ophalen en de opslag van de gezondheidsgegevens van uw geïmplanteerde apparaat mogelijk te maken via de applicaties myLUX™ en LUX-Dx™ Clinic Assistant;
- Toegang tot uw persoonsgegevens door uw arts of geautoriseerde gezondheidszorgprofessionals mogelijk te maken via de LATITUDE Clarity™ website;
- Uw zorgaanbieder te voorzien van meldingen voor specifieke gebeurtenissen, diagnostische gegevens en rapporten;
- Technische ondersteuning mogelijk te maken door medewerkers van Boston Scientific;
- Te voldoen aan regulatorische rapportvereisten met betrekking tot de kwaliteit en veiligheid van medische apparatuur aan openbare autoriteiten of regelgevende instanties in het land waar u verblijft of in de VS;
- Rechtsvorderingen in te stellen, uit te voeren of te verdedigen; en
- Te voldoen aan overige toepasselijke wettelijke en nalevingsvereisten.
De van de app verzamelde gegevens worden verzonden naar de LATITUDE Clarity website en enige analyse van dergelijke gegevens is onderworpen aan de instemming die is verkregen op het moment van de implantatie van het apparaat en de registratie.
Hoe lang bewaart Boston Scientific uw persoonsgegevens?
Uw gegevens worden door Boston Scientific bewaard als onderdeel van het verslag van uw geïmplanteerde apparaat tot 6 jaar nadat het apparaat inactief is geworden, tenzij een langere bewaartermijn noodzakelijk is om te voldoen aan een wettelijke verplichting.
Als u een mobiel apparaat met de applicatie hebt ontvangen en monitoring op afstand wenst te beëindigen, neem dan contact op met uw arts. Gegevens die door de mobiele applicatie op het mobiele apparaat zijn opgeslagen worden verwijderd wanneer de monitoring op afstand wordt beëindigd.
Als de applicatie zich op uw persoonlijke mobiele apparaat bevindt, merk dan op dat de gegevens die door de applicatie op uw mobiele apparaat zijn opgeslagen worden verwijderd als u de toepassing verwijdert. Wat zijn uw rechten?
U hebt specifieke rechten met betrekking tot de verwerking door Boston Scientific van uw persoons- en gezondheidsgegevens, die hier nauwkeurig worden omschreven. U hebt het recht om uw instemming met deze verwerking op elk willekeurig moment in te trekken. Het intrekken van uw instemming heeft geen invloed op de rechtmatigheid van de verwerking op basis van de instemming voordat deze werd ingetrokken.
U kunt onder bepaalde omstandigheden, zoals uiteengezet in toepasselijke wetgeving, de volgende rechten hebben:
- Recht op toegang: Het recht op bevestiging of uw persoonsgegevens al dan niet worden verwerkt en als dit zo is, om te verzoeken om toegang tot dergelijke persoonsgegevens alsmede overige informatie over dergelijke verwerking die ook is opgenomen in dit formulier.
- Recht op rectificatie: Het recht om onnauwkeurige persoonsgegevens over u te laten rectificeren of te laten aanvullen als deze incompleet zijn.
- Recht om gegevens te wissen ('recht om te worden vergeten'): Het recht om te verzoeken dat Boston Scientific uw persoonsgegevens wist.
- Recht op beperking van verwerking: Het recht om te verzoeken om bepekring van de wijze waarop Boston Scientific uw persoonsgegevens gebruikt.
- Recht van bezwaar: Het recht om op enig moment bezwaar aan te tekenen, om redenen van uw bepaalde situatie, tegen de verwerking van uw persoonsgegevens, waarna Boston Scientific mogelijk de verwerking van uw gegevens moet stoppen, tenzij zij dwingende legitieme gronden voor de verwerking aantoont die zwaarder wegen dan uw belangen, rechten en vrijheden of voor het instellen, uitvoeren of verdedigen van rechtsvorderingen.
- Recht op overdraagbaarheid van gegevens: Het recht om door u verschafte persoonsgegevens te ontvangen in een gestructureerde, algemeen gebruikte en machinaal leesbare vorm en om die gegevens over te dragen naar een andere beheerder of ze direct van Boston Scientific over te laten dragen naar een andere beheerder.
Privacyrechten Californië: De Boston Scientific Privacy Notice for California Residents verschaft aanvullende informatie voor inwoners van Californië onder de California Consumer Privacy Act van 2018 (CCPA).

De overdracht voor verwerkingslocaties buiten de EEA en het UK is toegestaan op basis van de standaard bepalingen van de Overeenkomst van beheerder naar verwerker.
In uitzonderlijke omstandigheden kunnen andere entiteiten van de Boston Scientific-groep, zoals BSC wereldwijde technische servicecentra in Australië en Japan, verzoeken ontvangen en behandelen die aan hen zijn gericht door uw arts - maar slechts voor zover noodzakelijk om voldoende en tijdige ondersteuning te leveren. Boston Scientific verwerkt uw persoonsgegevens voor de hierboven vermelde doeleinden op basis van uw instemming. Er wordt u gevraagd om in te stemmen met het verwerken van de myLUX™ Patient-app. Deze app voert geen enkele vorm van analyse uit.
Het geven van deze instemming is optioneel en u kunt deze op elk willekeurig moment intrekken. Als u monitoring op afstand van uw apparaat niet accepteert, neem dan contact op met uw kliniek om te beslissen wat de beste manier is om het monitoren van uw hartmonitor te beheren.
Ik begrijp dat ik het recht heb om: (i) dit instemmingsformulier niet te accepteren; (ii) instemming op elk willekeurig moment in te trekken; (iii) monitoring op afstand door mijn arts in te trekken; en (iv) mijn gegevens te laten verwijderen.
